The Al Ain Court of Civil, Commercial, and Administrative Cases dismissed a case filed by a man against another, requesting the return of Dhs200,000 that he claimed to have lent him. The plaintiff demanded that the appellee take a final oath to certify that his obligation was not outstanding, as well as Dhs50,000 in damages and legal fees. He also urged that the matter be referred for interrogation so that witness testimony may be heard.
The plaintiff claimed that the appellant borrowed Dhs200,000 from him three years before bringing the complaint out of friendship but failed to reimburse it. Both sides’ lawyers appeared in court, and the appellee’s counsel filed a memorandum saying that the debt could not be substantiated by witness testimony and requesting that the case be dismissed.
The plaintiff’s counsel submitted a memorandum supporting the request and requesting that the appellee take a decisive oath. The court ordered the appellee to take the final oath, swearing that he had not borrowed Dhs200,000 from the plaintiff and that his obligation was not outstanding. The court ruled that the decisive oath addressed the controversy by confirming the appellee’s debt-free status concerning the amount and thus dismissed the action.
