An eyeglasses company was sued by a medical equipment organization in Dubai Commercial Court for failing to pay for medical supplies. The corporation was ordered by the court to pay Dhs275,246 in addition to a five percent annual late payment interest until the whole amount was paid, as well as the charges, expenses, and legal fees that were incurred.
According to delivery receipts bearing the medical equipment establishment’s seal, the defendant received all supplies without any reservations. The medical equipment establishment claimed to have supplied medical and optical devices and equipment to the defendant under five invoices for the total amount claimed issued between January and April 2024.
The plaintiff claimed that the agreement required the value to be paid in monthly installments over a 12-month period via postdated checks, but the defendant failed to make the payment or provide proof that any portion of the debt had been paid, which led the plaintiff to file a lawsuit.
An accounting expert was appointed by the court during the proceedings, and in his report, he concluded that the commercial relationship between the two parties was established and that the signed invoices and receipts provided adequate proof that the plaintiff had fulfilled its obligations in contrast to the defendant’s nonpayment.
