The Abu Dhabi Labour Court of First Instance has mandated that a corporation compensate a fired employee with Dhs90,750 for not paying his wage for four straight months and without providing him with the notice-period allowance. A former employee filed a complaint against his former employer, asking the court to order the company to pay him Dhs74,250, or about four months’ unpaid wages, plus Dhs16,500, or one month’s salary, in lieu of notice.
Additionally, he asked that the judgement be made subject to prompt execution and that the firm be required to pay legal fees. According to the court, if the employment contract does not specify the type or amount of compensation, the competent court will decide it and treat the case as a labour dispute.
It further stated that, in compliance with the terms, conditions, and procedures outlined in the executive rules of this decree-law, as well as the ministry-approved regulations, the employer must pay wages to employees on their respective due dates.
