In addition to costs, expenses, and legal fees, the Dubai Commercial Court ordered a man to pay an additional Dhs6.4 million, the equivalent of two checks, plus 5% legal interest starting on August 1, 2023, until the whole amount is paid.
at specifics, a man filed a complaint at the Dubai Commercial Court, asking that another be compelled to pay Dhs6.4 million—the sum of two checks made out to him—as well as 5% legal interest from the due date till payment.
The plaintiff clarified that the appellee gave him two checks, one for Dhs2.2 million and the other for Dhs4.2 million, to be cashed in July and August of 2023. However, the appellee took advantage of their friendship by asking him not to present the checks to the bank on their due dates, and he kept making repeated promises to pay.
The plaintiff further stated that when the deadline for presenting the checks had passed, he attempted to cash them but was unable to do so since their due dates had passed. As a result, a legal notice seeking debt settlement was given to the appellee, but he did not reply, which led him to file a lawsuit.
While the appellee was lawfully notified but failed to show up for the court proceedings, the plaintiff presented copies of the two checks, their return statements, the legal notice, and proof of notification to the court.
