A man was fined Dhs5,000 and forced to return Dhs75,000 to another man who bought a motorcycle from him by the Al Ain Court of Civil, Commercial, and Administrative Cases. According to the details, a man filed a lawsuit against another, asking for a judgment to revoke the sales contract and return things to how they were before the contract was signed. He was also ordered to pay him Dhs100,000, with compensation of Dhs50,000, in addition to a 12% annual legal interest from the date of the claim until full payment, as well as the fees and expenses of the lawsuit and attorney fees.
In his case, the complainant claimed to have signed a contract with the appellee to purchase a motorcycle from him, conceding that he had thoroughly inspected the vehicle and that they had decided on a Dhs100,000 bank check as the sale price.
He further stated that although he gave the appellee the check, the latter failed to deliver the motorcycle, which is a violation of the good faith principle and his contractual obligations. The complainant further stated that he filed the complaint because the appellee used the check even though the motorcycle was not delivered.
In response to the complainant’s request for a witness, the court heard testimony from a witness who, after taking a legal oath, stated that he was friends with the complainant and had previously dealt with the appellee. He also stated that he accompanied the complainant to the appellee’s shop to finalize the purchase deal and that he remained outside the shop rather than entering the meeting place.
